Senate Panel Approves McCain National Guard
Border Deployment Amendment

A Senate panel on Thursday, May 27, agreed to language authored by Senator John McCain (R-AZ) to require the deployment of 6,000 National Guard Troops along the U.S. border with Mexico. Action on the matter occurred late in the afternoon on May 27 during a closed-door markup of the Fiscal Year 2011 National Department of Defense Authorization Act in the Senate Committee on Armed Services.
Senator McCain, the Committee's Ranking Republican, offered the National Guard border deployment language as an amendment to the Defense bill. According to Chairman Carl Levin (D-MI), the Committee agreed to the McCain amendment by a vote of 15-13. The Committee went on to approve the draft National Defense Authorization Act by a vote of 18-10, readying it for full Senate consideration sometime in June or July.
Thursday's Armed Services Committee action was ironic on at least two levels. First, the full Senate had just a few hours earlier rejected an amendment on the same subject that Senator McCain had offered to H.R. 4899, the fiscal year 2010 emergency supplemental appropriations bill. And second, the Arizona senator and many of his fellow Republicans have pledged to filibuster the Fiscal Year 2010 National Defense Authorization Bill because of the inclusion in the measure of "Don't Ask, Don't Tell" language liberalizing the policy of the U.S. armed forces with respect to gay and lesbian soldiers, airmen, sailors, and marines.
As approved by the Committee, the McCain National Guard Border Deployment Amendment would require the Secretary of Defense to send 6,000 National Guard personnel to help secure the U.S.-Mexico border. Under the amendment, the National Guard personnel would serve in State status, but would be paid out of Federal funds. The Department of Defense estimates the costs of the deployment at $700 MILLION per year, including both personnel and operating costs.
The Obama Administration strongly opposes the McCain amendment, contending in a May 25, 2010, letter to the Committee that the provision would interfere with the President's prerogatives as Commander-in-Chief.
In remarks to reporters on Friday, May 28, Chairman Levin was critical of the McCain amendment and predicted difficulty for it in the weeks and months to come. Like the Obama Administration, Chairman Levin contends that the provision is unconstitional. He said of it, "I believe that this would be an issue on the floor as to whether or not the Congress has the authority to direct troops to go to specific locations. There's no precedent for that, according to the Library of Congress. We can add, we can recommend, we can fund, we can prohibit, but can you direct the commander in chief to send troops to a specific place? There's no precedent for it." Levin went on to suggest that "we'll be hearing from the President, I assume, or his security adviser again on this" and to predict a difficult fight either on Senate floor or in conference over whether or not to strike the provision from the bill.

Senate Approves Supplemental Fiscal Year 2010 Refugee and Haitian TPS, Reception, and Placement Funding

The Senate has approved a measure that would provide an additional $165 MILLION in fiscal year 2010 for the Department of State's Migration and Refugee Assistance Account (MRA) account; $100 MILLION in Economic Support Fund (ESF) assistance to Jordan to help it deal with refugees; an additional appropriation of $465 MILLION in fiscal year 2010 for International Disaster Assistance (IDA) funds for Haiti; and an additional appropriation of $10.6 MILLION to assist in the adjudication, placement, and reception of Haitian Temporary Protected Status (TPS) applicants.
Senate action on the spending provisions occurred on Thursday, May 27, 2010, in connection with the Senate version of H.R. 4899, a bill making emergency supplemental appropriations for disaster relief and summer jobs for the fiscal year ending September 30, 2010, and for other purposes. The Senate passed the measure by a vote of 67-28 after turning back a number of attempts to add border security provisions to it.
With respect to funding for refugees, the Senate-approved measure would provide:
- Migration and Refugee Assistance Account. $165 MILLION for the MRA account, "to be used for assistance for Iraqi, Afghan, Pakistani, Congolese, Burmese, and Somali refugees and IDPs." The recommended level of appropriation would be in addition to $1.685 BILLION that was appropriated in the regular fiscal year 2010 appropriations process. The Obama Administration did not ask for the appropriation of any funds for MRA in its supplemental appropriations request.
- Economic Support Fund Account. $100 MILLION in ESF account funds for "for assistance for Jordan to help meet the needs of Iraqi refugees and address other pressing economic issues."
- International Disaster Assistance for Haiti. $465 MILLION in IDA funds, which the Committee indicates "may be used to reimburse obligations made prior to enactment of this act related to emergency relief and recovery efforts in Haiti following the earthquake of January 12, 2010, including to reimburse the IDA account to respond to humanitarian disasters worldwide, and an estimated $126,000,000 for reimbursable interagency agreements between USAlD's Office of United States Foreign Disaster Assistance and other Federal agencies." The Obama Administration asked for only $350 MILLION for this purpose.
- TPS and Humanitarian Parole for Haitians. $10.6 MILLION to the U.S. Citizenship and Immigration Services (USCIS) bureau "for reception and resettlement services provided under the Cuban-Haitian Entrant Program; fee waivers for eligible Haitians granted TPS; and the humanitarian parole program to bring medical evacuees and certain categories of Haitians into the United States." The Obama Administration requested $15 MILLION in emergency funding for USCIS, $11,000,000 of which was based on the estimated receipt of up to 250,000 Temporary Protected Status [TPS] applications.

The Full Senate Rejects Four GOP Border Security
Amendments to Supplemental Appropriations Bill

The full Senate on Thursday, May 27, rejected four Republican-authored border sec urity amendments to H.R. 4899, an emergency supplemental appropriations bill that the United States Senate had under consideration. The four amendments were authored by Senators John Cornyn (R-TX), Jon Kyl (R-AZ), John McCain (R-AZ), and Jim DeMint (R-SC). They would have added nearly $2.5 BILLION in border security and immigration enforcement spending to the measure.
In floor activity on Thursday, the Senate took the following actions on the four border security amendments:
- McCain National Guard Amendment. The Senate rejected McCain Amendment Number 4214 by a vote of 51-46 (60 affirmative votes were needed in order for the amendment to pass). The McCain amendment would have increased funding in the supplemental appropriations bill by $250 million in order to fund the deployment of 6,000 National Guard troops on the U.S. border with Mexico. It was cosponsored at the time of its submission by Senators Kyl, Kay Bailey Hutchison (R-TX), Cornyn, Lindsay Graham (R-SC), Johnny Isakson (R-GA), Pat Roberts (R-KS), Saxby Chambliss (R-GA), and James Webb (D-VA).
- Kyl-McCain Operation Streamline Amendment. The Senate rejected Kyl-McCain Second Degree Amendment Number 4228 (link is to the text of the amendment prior to being modified) to Cornyn Amendment Number 4202. The Senate rejected the Kyl-McCain amendment by a vote of 54-44 (60 affirmative votes were needed in order for the amendment to pass). It would have increased funding by $200 MILLION in order to expand "Operation Streamline," a program that provides for the criminal prosecution and mandatory prison sentences for persons who enter the United States without inspection.
- Cornyn Border Security Amendment. The Senate rejected Cornyn Amendment Number 4202 by a vote of 54-43 (60 affirmative votes were needed in order for the amendment to pass). The Cornyn amendment would have increased funding by $2 BILLION for a variety of border security functions. Among the activities and material that it would have funded are additional equipment along the U.S. border with Mexico, including additional helicopters and drones; additional funding for ICE, CBP, DEA, BATF, and the National Guard; additional funding for various task forces and fusion centers that are intended to increase intergovernmental and interagency border security and immigration cooperation; additional funding for facilities and personnnel involved in detention and removal operations; and funding for infrastructure improvements at U.S. ports of entry.
- DeMint Border Fencing Amendment. The Senate rejected a DeMint Amendment Number 4177 by a vote of 45-52 (67 affirmative votes were needed in order for the amendment to pass). The DeMint amendment would have required the Department of Homeland Security to complete the construction of 700 miles of double-layered fencing along the U.S. border with Mexico within a year after the date of enactment of the Supplemental Appropriations Bill.
All four amendments were opposed by the pro-immigrant advocacy community and supported by immigration restrictionists. The first three were considered under procedures requiring they receive at least 60 votes in order to be passed by the Senate. The fourth amendment, offered by Senator DeMint, was brought up under a rarely used procedure that required the affirmative votes of 67 senators.
As a technical matter, the votes on the first three amendments were cast on whether to waive Budget Act points of order against the amendments rather than on the amendments, themselves. Each of the first three amendments received more than 50 votes, which means if they are brought up later this year in a context that does not require 60 votes, the amendments might well pass.
Thursday's Senate floor votes on the four border security amendments occured just two days after the Obama Administration leaked word that it soon will ask Congress for a supplemental appropriation of $500 million for enhanced border protection and the deployment of up to 1,200 National Guard troops on the U.S.-Mexico border. Word of the forthcoming Administration request angered many pro-immigrant advocates and a few pro-immigrant senators. However, the Administration's move may well have provided enough cover for Democrats to defeat the border security amendments.
Republicans needed the affirmative votes of at least 19 Democrats on the McCain, Kyl, and Cornyn border security amendments in order to prevail. While they were able to win the votes of 19 different Democratic senators on at least one of the three amendments, they were not able to win 19 Democratic votes on any single amendment:
- Democratic Senators Voting For All Three Amendments. Six Democratic senators voted for all three border security amendments to H.R. 4899: Senators Evan Bayh (D-IN), Barbara Boxer (D-CA), Dianne Feinstein (D-CA), Claire McCaskill (D-MO), Ben Nelson (D-NE), and Jim Webb (D-VA).
- Democratic Senators Voting For Two of the Three Amendments. Five Demoratic senators voted for two of the three border security amendments to H.R. 4899: Senators Amy Klobuchar (D-MN), Joe Lieberman (I-CT), Blanche Lincoln (D-AR), Mark Pryor (D-AR), and Jon Tester (D-MT).
- Democratic Senators Voting for One of the Three Amendments. Eight Democratic senators voted for only one of the three border security amendments to H.R. 4899: Senators Mark Begich (D-AK), Michael Bennet (D-CO), Herb Kohl (D-WI), Mary Landrieu (D-LA), Jeff Merkeley (D-OR), Bill Nelson (D-FL), Ron Wyden (D-OR), and Mark Udall (D-CO).

President Obama Comments for the First Time on His Decision to Send National Guard Troops to the Border

President Barack Obama on Thursday commented for the first time on his widely reported decisions to send up to 1,200 National Guard troops to the U.S. border with Mexico and request $500 MILLION in supplemental funds for border security. The President addressed the two matters during a May 27, 2010, early afternoon press conference that was broadcast from the East Room of the White House. In addition to commenting on his decisions on the deployment of National Guard troops and his request for supplemental funding for border security, the President also spoke to reporters about his desire to win enactment of comprehensive immigration reform, his opposition to the Arizona immigration enforcement law, and his meeting earlier in the week with the Senate Republican Conference.
In his remarks, the President said that his decision to deploy National Guard troops along the U.S. border with Mexico had been a year in the making and that it was not a direct result of the Arizona law. He said the National Guard troops will be used for intelligence, dealing with drug and human trafficking along the border, and to relieve Border Patrol agents so they may be freed up for law enforcement activities along the border.
The President reiterated his support for comprehensive immigration reform in his remarks, saying that the deployment of National Guard troops should not be viewed in isolation.
The House Committee on Appropriations already has responded to the President's request, placing $500 MILLION in its draft fiscal year 2010 supplemental appropriations bill and providing for the transfer of funding to support the deployment of up to 1,200 National Guard troops on the border. However, the House late Thursday afternoon scrapped plans to markup that measure, postponing any markup until June or later.
The Senate rejected attempts to add as much as $2.5 BILLION in border security funds in its version of the supplemental appropriations bill. Most observers expect the President's request to survive in the bill that eventually is enacted into law.

GOP Border Security Amendments to
Supplemental Appropriations Bill

The Senate is set to vote shortly after 10:00 am EDT on Thursday, May 27, on three border security amendments offered by Republicans to H.R. 4899, an emergency supplemental appropriations bill that currently is pending before the United States Senate.
The three amendments are authored by Senators John Cornyn (R-TX), Jon Kyl (R-AZ), and John McCain (R-AZ):
- Cornyn Border Security Amendment. The Cornyn amendment Number 4202 would increase funding by $2 billion for a variety of border security functions. Among the activities and material that it would fund are additional equipment along the U.S. border with Mexico, including additional helicopters and drones; additional funding for ICE, CBP, DEA, BATF, and the National Guard; additional funding for various task forces and fusion centers that are intended to increase intergovernmental and interagency border security and immigration cooperation; additional funding for facilities and personnnel involved in detention and removal operations; and funding for infrastructure improvements at U.S. ports of entry.
- Kyl-McCain Operation Streamline Amendment. Each of the three amendments will likely have to win the votes of 60 of the Senate's 100 members in order for the amendments to be deemed passed. This means that if all 100 senators are present and voting and all of the Senate's 41 Republicans vote in favor of the three amendments, 19 of the Senate's 59 Democrats would have to vote in favor of them in order for them to pass. Looking at the math another way, so long as 41 or more of the 59 Democrats in the Senate vote against the amendments, the amendments will fail.
The Senate vote on the three amendments will come just two days after the Obama Administration announced it was asking for a supplemental appropriation of $500 million in supplemental funds for enhanced border protection while deploying up to 1,200 National Guard troops on the U.S.-Mexico border. The Administration announcement angered many pro-immigrant advocates. However, it could be enough of a move to convince 41 or more Senate Democrats to oppose one or more of the three amendments.

House Appropriations Committee to Take Up Its Version of Emergency Supplemental Fiscal Year 2010 Appropriations Bill

The House Committee on Appropriations has scheduled a markup for Thursday, May 27, 2010, at which time it is expected to take up its version of H.R. 4899, an emergency fiscal year 2010 supplemental appropriations bill. A combination of staff sources and an early draft of the measure indicates that the measure that the Committee will take up will include $500 million in border security funds that the Obama Administration asked for on Tuesday, May 25; permit the transfer of exisiting appropiations to accomodate the deployment of 1,200 National Guard troops on the U.S. border with Mexico, as the Adminisration asked for on Tuesday; and appropriate nearly $11 million to the Department of Homeland Security to help defray the costs associated with adjudicating Temporary Protected Status (TPS) applicatons from Haitians displaced by the earthquake that devasted the island nation at the beginning of 2010.
From a refugee perspective, the early draft of the measure reveals significant differences between it and the version of H.R. 4899 that the Senate Committee on Appropriations approved last month and that the full Senate has under consideration at the time of this writing:
- Migration and Refugee Assistance Account. The draft House measure would not appropriate any funds for the Department of State's Migration and Refugee Assistance (MRA) account to provide overseas refugee assistance to refugees and internally displaced persons. This compares to an appropriation of $165 MILLION for the MRA account in the Senate bill, which the Senate Committee on Appropriations desigated "to be used for assistance for Iraqi, Afghan, Pakistani, Congolese, Burmese, and Somali refugees and IDPs." The Senate bill's recommended level of appropriation would be in addition to $1.685 BILLION that was appropriated in the regular fiscal year 2010 appropriations process. The Obama Administration did not ask for the appropriation of any funds for MRA in its supplemental appropriations request.
- Economic Support Fund Account. The draft House measure would appropriate $749.3 MILLION in ESF funds for Haiti, which is the same amount requested by the Administration. In addition, the draft House measure would appropriate $90 MILLION in ESF funds for Jordan. This compares to $100 MILLION in ESF funds for Jordan that is contained in the Senate Appropriations Committee-reported measure, which specifies that the funds be used "for assistance for Jordan to help meet the needs of Iraqi refugees and address other pressing economic issues."
- International Disaster Assistance for Haiti. The draft House measure would appropriate $350.7 MILLION in IDA funds for Haiti. This compares to $465 MILLION in IDA funds contained in the Senate Appropriations Committee-reported version of the bill.
- TPS and Humanitarian Parole for Haitians. Like the Senate Appropriations Committee-reported version of the bill, the draft House measure would appropriate $10.6 MILLION to the U.S. Citizenship and Immigration Services (USCIS) bureau to defray costs associated with providing services to Haitians in the United States who were displaced by the January earthquake.
From a border security perspective, the draft House measure would appropriate $500 MILLION for border security operations, including the following:
- Customs and Border Protection. $356.9 BILLION for salaries and expenses for the U.S. Customs and Border Protection (CBP) component of the Department of Homeland Security, including $208 MILLION to hire 1,200 additional Border Patrol agents and support personnel.
- Tacitical Communications. $55 MILLION for designing, building, and deploying tactical communications to support enforcement activities along the border, as well as to build Border Patrol forward-operating facitlities.
- ICE Southwest Border Law Enforcement Activities. $30 MILLION for the Immigration and Customs Enforcement (ICE) component of the Department of Homeland Security for the Southwest border law enforcement operations.
- Operation Stonegarden. $50 MILLION for Operaton Stonegarden, which allocates grants to local law enforcement for personnel and training costs associated with stopping illegal immigration and drug smuggling along the border.
In addition, with regard to the deployment of National Guard troops:
- Transfers from Other Accounts. allows for the transfer of $177.2 MILLION of funds from other accounts to pay for the deployment of additional National Guard troops.

President Obama Meets with Senate Republicans on
Immigration Reform and Other Issues

President Barack Obama made a rare trip to the Capitol Building on Tuesday, May 25, to talk with the entirety of the Senate Republican Conference. Immigration was one of the key issues that was discussed at the meeting. By most reports, the meeting was testy, lively, and spirited, with Senators John McCain (R-AZ) and Senate Minority Whip Jon Kyl (R-AZ) confonting the President on his position on the recently enacted Arizona immigration enforcement law, comprehensive immigration reform, and border security measures.
The Senate Republican Leadership held a press conference following the meeting, at which they characterized their side of the talk with the President and spoke about their preferred legislative agenda on immigration and other issues. Senators Kyl and John Cornyn (R-TX) indicated during the press conference that they plan to push for a vote on at least one amendment to a pending supplemental appropriations bill to increase border security funding.

Senators Prepare Border Security-Related Amendments to Supplemental Appropriations Bill

A number of senators are preparing immigration- or border security-related amendments to H.R. 4899, an emergency supplemental appropriations bill that currently is pending before the United States Senate. The Senate Democratic Leadership is pushing for the Senate to complete consideration of the measure this week before it leaves for its scheduled week-long Memorial Day recess. Votes on amendments to the measure, including any border security-related ones, could occur as soon as today.
In all, about five immigration- or border security-related amendments had been discussed by various senators as possible amendments to H.R. 4899. They include a border fencing amendment that Senator Jim DeMint (R-SC) is considering offering, an unmanned aerial vehicle amendment that Senator Kay Bailey Hutchison (R-TX) is rumored to be preparing, a national guard amendment that Senator Hutchison is said to be contemplating offering, and a more comprehensive border security amendment that Senators John McCain (R-AZ) and Jon Kyl (R-AZ) are reportedly considering offering that would be based on a border security bill that they recently introduced.
But the amendment that seems to be receiving the most serious attention is one that Senator John Cornyn (R-TX) has filed. The Cornyn border security amendment is cospnsored by Senators Kyl, Hutchison, and McCain, authors of several of the amendments that are rumored to be under consideration for being offered.

Immigration-Related Appropriations and Defense Authorization Amendments Likely to Dominate This Week's
Immigration and Refugee Agenda

Immigration-related appropriations and defense amendments are likely to dominate this week's immigration and refugee legislative agenda as Congress enters its last week before a week-long Memorial Day recess.
Immigration-related amendments could come on four fronts this week:
- the full Senate will take up an emergency fiscal year 2010 supplemental appropriations bill beginning on Monday, May 24, and it likely will have the measure under consideration through the entirety of the week;
- the full House will take up its Fiscal 2011 National Defense Authorization Act, and Members are expected to seek permission to offer border security-related amendments to the measure;
- the Senate Committee on Armed Services will take up its Fiscal Year 2011 National Defense Authorization Act, and senators are expected to offer border security-related amendments to the bill; and
- the House Committee on Appropriations could take up its version of the emergency fiscal year 2010 supplemental appropriations bill by mid-week this week. If it does so, it is likely that GOP Members will seek to offer immigration enforcement-related amendments to the draft measure.

An Address by Mexican President Calderon to a Joint Meeting of Congress, a Hearing on the Refugee Protection Act, and a Possible Border Fencing Floor Amendment Highlight this Week's Immigration and Refugee Agenda

A Wednesday meeting and press conference involving President Barack Obama and Mexican President Filipe de Jesus Calderon Hinojosa, a Thursday address to a joint meeting of Congress by President Calderon, and a Thursday State Dinner at the White House for the Mexican President and First Lady highlight this week's immigration-related Washington happenings.
The subject of immigration and the new Arizona immigration enforcement law is likely to come up during the joint meeting of Congress and the State Dinner at the White House, as well as in the meeting and news conference involving Presidents Obama and Calderon.
In addition to events surrounding the Mexican President's visit to the United States, four congressional hearings , one markup, and two potential floor actions also are on the this week's immigration- and refugee-related legislative agenda.
This week's immigration- or refugee-related hearings include:
The sole markup at which immigration is likely to come up is a markup in the House Committee on Armed Services of H.R. 5136, the Fiscal Year 2011 Defense Authorization Act. The measure could become the target of amendments by Members who wish to deploy U.S. military personnel and material along the U.S. border with Mexico.
As far as this immigration- or refugee-related week's floor action goes, the Senate is expected to resume consideration of S. 3217, the "Restoring American Financial Stability Act of 2010", a financial regulatory reform bill. Senator Jim DeMint (R-SC) has pledged to use the measure as a vehicle for a Floor Amendment that would require the Department of Homeland Security to complete the construction of 700 miles of double-layered fencing along the U.S. border with Mexico. And pro-immigrant advocates are on the lookout for a procedural motion that they speculate House Republicans could offer relating to the E-Verify system in connection with the expected House consideration of a new version of H.R. 5116, the America COMPETES Reauthorization Act of 2010. In addition, it is possible that the full Senate this week could take up a fiscal year 2010 supplemental appropriations bill that contains supplemental Migration and Refugee Assistance funding for overseas refugee assistance, Economic Support Fund assistance to Jordan to assist it in absorbing refugees, increased International Disaster Assistance (IDA) for Haiti; and supplemental funding for the U.S. Citizenship and Immigration Services (USCIS) bureau to assist Haitian TPS applicants and recipients.

DeMint Effort to Attach Border Fencing Amendment to Financial Regulatory Reform Bill is Thwarted ... For Now

Senator Jim DeMint (R-SC) made an attempt to attach his border fencing proposal to another pending amendment to the financial regulatory reform bill on Thursday, May 13. However, the DeMint attempt failed when the author of the amendment that he sought to attach his proposal to withdrew it from consideration. Despite Thursday's failure, Senator DeMint has promised to continue attempting to get a vote on his amendment in connection with the financial regulatory reform bill.
Yesterday's action began around 5:00 pm EDT, when Senator DeMint offered his border fencing amendment to a proposal of Senator Ron Wyden's (D-OR) to curtail the use of secret holds on legislation and nominations. The Wyden proposal had gained widespread, bipartisan popularity in the Senate, and it had appeared up to that point that it would sail through the Senate with as many as 80 votes. Senator DeMint surprised the Senate (and Senator Wyden) by offering his "second degree" amendment to the Wyden proposal without notice. After an hour of heated behind-the-scenes discussion, Senator Wyden agreed to withdraw his proposal rather than accept a vote on the DeMint fencing amendment.
Senator DeMint originally filed his border fencing amendment to S. 3217, the "Restoring American Financial Stability Act of 2010", on Wednesday, May 5. At the time, it was filed as Senate Amendment 3852. The amendment would require the Department of Homeland Security to complete the construction of 700 miles of double-layered fencing along the U.S. border with Mexico.
In announcing his plan to offer his fencing amendment, Senator DeMint said doing so would "follow through on the four-year-old promise made by Congress to secure the border under the Secure Fence Act of 2006." Senator DeMint quoted Department of Homeland Security (DHS) staff as saying that to date, only 34.3 miles of the mandated 700 miles of double layer fencing has been built. He says that 11.8 of that fencing has been built in California, 9.1 in Arizona, and 13.4 in Texas.
The South Carolina Senator offered a similar amendment last year in the Senate to H.R. 2892, the Department of Homeland Security Appropriations Act. The Senate approved the amendment at that time by a vote of 54-44, with 21 Democrats and 33 Republicans voting in favor of it. However, the DeMint amendment was one of several immigration and border enforcement amendments that were dropped from the Homeland Security Appropriations measure in conference.
“We’ve now had two administrations fail to keep their promise to the American people to secure our border and Americans are tired of excuses,” said Senator DeMint. “Americans have demanded a real fence to combat the very real problems of illegal immigration that have led to human trafficking, drug trafficking, kidnapping and violence on our border. Congress will never be able to achieve long-term reform to create a legal immigration system that works until we secure our borders.
“We’ve had rhetoric and promises for four years without results. It’s time we completed the fence and secured our borders to protect American citizens.”
If Senator DeMint’s amendment is signed into law, Secretary of Homeland Security Janet Napolitano would be required to submit a report to Congress within six months (or 180 days) after enactment of the law on the progress made and her plans for completing the fence within twelve months.

Senate Appropriations Committee Approves Supplemental Fiscal Year 2010 Refugee and Haitian TPS, Reception, and Placement Funding

The Senate Committee on Appropriations on Thursday, May 13, approved a measure that would provide an additional $165 MILLION in fiscal year 2010 for the Department of State's Migration and Refugee Assistance Account (MRA) account; $100 MILLION in Economic Support Fund (ESF) assistance to Jordan to help it deal with refugees; an additional appropriation of $465 MILLION in fiscal year 2010 for International Disaster Assistance (IDA) funds for Haiti; and an additional appropriation of $10.6 MILLION to assist in the adjudication, placement, and reception of Haitian Temporary Protected Status (TPS) applicants.
Thursday's Senate Appropriations Committee action occurred in connection with the Senate version of H.R. 4899, a bill making emergency supplemental appropriations for disaster relief and summer jobs for the fiscal year ending September 30, 2010, and for other purposest. The Committee approved the measure by a vote of 30-0, readying it for consideration by the full Senate.
With respect to funding for refugees, the Committee-approved measure would provide:
- Migration and Refugee Assistance Account. $165 MILLION for the MRA account, "to be used for assistance for Iraqi, Afghan, Pakistani, Congolese, Burmese, and Somali refugees and IDPs." The recommended level of appropriation would be in addition to $1.685 BILLION that was appropriated in the regular fiscal year 2010 appropriations process. The Obama Administration did not ask for the appropriation of any funds for MRA in its supplemental appropriations request.
- Economic Support Fund Account. $100 MILLION in ESF account funds for "for assistance for Jordan to help meet the needs of Iraqi refugees and address other pressing economic issues."
- International Disaster Assistance for Haiti. $465 MILLION in IDA funds, which the Committee indicates "may be used to reimburse obligations made prior to enactment of this act related to emergency relief and recovery efforts in Haiti following the earthquake of January 12, 2010, including to reimburse the IDA account to respond to humanitarian disasters worldwide, and an estimated $126,000,000 for reimbursable interagency agreements between USAlD's Office of United States Foreign Disaster Assistance and other Federal agencies." The Obama Administration asked for only $350 MILLION for this purpose.
- TPS and Humanitarian Parole for Haitians. $10.6 MILLION to the U.S. Citizenship and Immigration Services (USCIS) bureau "for reception and resettlement services provided under the Cuban-Haitian Entrant Program; fee waivers for eligible Haitians granted TPS; and the humanitarian parole program to bring medical evacuees and certain categories of Haitians into the United States." The Obama Administration requested $15 MILLION in emergency funding for USCIS, $11,000,000 of which was based on the estimated receipt of up to 250,000 Temporary Protected Status [TPS] applications.
Congressional Quarterly has reported that the timing of when the Senate might take up H.R. 4899 is uncertain, quoting Senate Appropriations Committee Chairman Daniel Inouye (D-HI) as saying after the markup, "[t]he only thing I can say is that we’ve been assured that this measure will be taken up for consideration and passed before the recess.”

Pro-Immigrant Advocates Dodge Bullet For Now as an Anticipated House GOP Move on the E-Verify System Fails to Materialze

Pro-immigrant advocates were braced on Thursday, May 13, fo r what they thought might be a GOP effort to force a vote on the E-Verify system. However, by about Noon, it becameDeMin obvious that the vote on the E-Verify system that they were anticipating was not going to take place. Had such a vote been forced, it would have been the first time this year that there was a contested vote in the House on an immigration-related matter.
The vote that advocates were anticipating on Thursday morning was a vote on what they thought would be a procedural motion in connection with H.R. 5116, the America COMPETES Reauthorization Act of 2010, which the House had had under consideration throughout Wednesday, May 12, and Thursday, May 13. That measure would reauthorize funding for several science, technology, education, mathematics, and engineering programs.
Representative Brian Bilbray (R-CA), Chairman of the immigration restrictionist-oriented Immigration Reform Caucus, had signaled on Wednesday that he hoped to force the House of Representatives to vote on the controversial E-Verify system as part of its debate on H.R. 5116. Because of procedural limitations, the only avenue that Bilbray could have used to force a vote on the controversial system was a motion to recommit (MTR) H.R. 5116 to the originating committee with instructions that an amendment on the system be added to the bill. Republicans only get one opportunity per bill to offer a MTR. In the end, the House Republican Leadership decided to make the Motion to Recommit concentrate on other issues.
Opponents of expanding the E-Verify system are not yet out of the woods, however. House Republicans actually succeeded in using their MTR to attach provisions to H.R. 5116 that the House Democratic Leadership has found objectionable. This prompted the Leadership to pull H.R. 5116 from the House floor and to pledge to bring it back before the full House of Representatives next week. Thus, it is possible that the House GOP will offer an E-Verify-related MTR to the measure at that time.

USCIS Director Foreshadows a Coming Fee Increase, Discusses Organizational Changes, and Dodges Controversial Questions During Appearance Before the Senate Judiciary Committee

U.S. Citizenship and Immigration Services (USCIS) Director Alejandro Mayorkas told senators on Tuesday, May 11, that he has conducted a review of USCIS's funding needs and shortfalls and that a revision of fees is now pending in the Agency. He also told senators that he has conducted a bottom-to-top review of USCIS's operations and that, as a result he has made a number of changes in USCIS's structure. Mayorkas's comments were made during a May 11, 2010, appearance at a Senate Judiciary Committee oversight hearing on the operations of USCIS.
Mayorkas told the Committee that he has realigned USCIS's organizational structure to create a new Fraud Detection and National Security Directorate (FDNS) focused on detecting, combating, and deterring threats to our public safety and fraud in our system; implemented an Administrative Site Visit and Verification Program (ASVVP) that seeks to augment USCIS nationwide anti-fraud efforts and strengthen the integrity of the United States legal immigration system; implemented more than 15,000 site inspections aimed at verifying key eligibility requirements; created the Customer Service Directorate to improve the way in which USCIS provides information and services to the public; implemented an improved website to improve the ability of USCIS customers to access the information and assistance they need; and implemented and continues to provide enhancements to My Case Status Online, which provides customers with direct access to case status information.
Mayorkas said during the hearing that USCIS is issuing a re-designed Permanent Resident Card (Green Card), which modernizes the Green Card with the most sophisticated security technology available today, including additional security features, such as embedded data and holographs, which make it more difficult to produce fraudulent cards and easier for DHS to identify fraud.
Mayorkas addressed USCIS's work with regard to Haiti during the hearing, saying that his agency has processed more than 43,000 requests for Haitian Temporary Protected Status (TPS) in the wake of the recent earthquake there. In addition, Mayorkas said employees at USCIS worked long hours, including through weekends, holidays, and the snow storms, to implement Secretary Napolitano's January 18, 2010 announcement of humanitarian parole for certain Haitian orphans in order to allow them to be united with their adoptive families and to receive the care they need. Mayorkas told the Senators that USCIS's reponse to the Haitian earthquake has helped it identify areas where improvements in its other operations are needed.
Director Mayorkas fielded a number of questions during the hearing, punting most of the more controversial ones until he has had an opportunity to consult with his staff.

Controversy Over Arizona Immigration Enforcement Law Continues As Governor Brewer Creates Ad Attacking Obama, and Senator Menendez Urges Boycott of 2011 Major League Baseball All Star Game

Nearly three weeks after Governor Jan Brewer (D-AZ) signed the most sweeping state law against illegal immigration in the country, the controversy over the measure shows no signs of subsiding.
In response to a joke that President Obama recently told about the Arizona law during the annual White House Correspondents dinner, Governor Brewer's campaign has produced an internet ad that attacks the President for making light of the issue and criticizes him for what the Governor says is his failed performance on immigration and border security.
In the meantime, calls for an economic boycott of Arizona over the new law continue to grow, and a counter-effort has been established calling on supporters of the Arizona law to BuyArizona.
On Monday, May 10, Senator Bob Menendez (D-NJ) stepped up the pressure on Arizona, sending a letter to the Major League Baseball Players Association (MLBPA) urging it to consider boycotting the 2011 All Star Game, whichi is scheduled to be played in Phoenix, Arizona, until SB 1070 is repealed or the League decides to move the game to an alternate location.

Two Oversight Hearings and a Possible Border Fencing Amendment Highlight This Week's Immigration and Refugee Legislative Agenda

Two oversight hearings and possible floor action on a border fencing amendment highlight the nation's capitol's immigration- and refugee-related legislative agenda this week.
This week's relatively light immigration legislative schedule includes a Senate Committee on the Judiciary oversight hearing on the activities of the Department of Homeland Security's U.S. Citizenship and Immigration Services (USCIS) bureau and a House Committee on the Judiciary oversight hearing on the activities of the U.S. Department of Justice (DOJ). Testifying at the first hearing will be Alejandro Mayorkas, Director of USCIS. Attorney General Eric H. Holder, Jr. is expected to be the sole witness at the second hearing.
As far as this immigration- or refugee-related week's floor action goes, the Senate is expected to resume consideration of a financial regulatory reform bill which Senator Jim DeMint (R-AR) has pledged to use as a vehicle for a floor amendment that would require the Department of Homeland Security to complete the construction of 700 miles of double-layered fencing along the U.S. border with Mexico.
The DeMint border fencing amendment is one of nearly 180 amendments that had been filed to the financial regulatory reform bill by the end of last week. It is far from certain that the senior senator from Arkansas will actually get the opportunity to offer his amendment to the measure this week.

Much like the last several weeks, to the extent that immigration was discussed, those discussions focused on two matters: the new immigration enforcement law in Arizona and the push for comprehensive immigration reform.

Senators McCain and Kyl Introduce Bill Implementing Their Ten-Point Border Security Plan as McCain Runs Campaign Ads
Touting the Measure

Senators John McCain (R-AZ) and Jon Kyl (R-AZ) have introduced a border security bill patterned after a ten-point plan on border security that they released in early April. The two senators introduced the measure, titled the "Border Security Enforcement Act of 2010", on Thursday, May 6. Perhaps not so coincidentally, Senator McCain, who is locked in a battle for the GOP nomination for the U.S. Senate with former Representative J.D. Hayworth (R-AZ), began this week running television ads in Arizona touting the McCain/Kyl border security plan.
Senators McCain and Kyl announced their ten-point plan on Monday, April 10, 2010, at a press conference in Washington, DC. They were joined at their announcement by several Arizona sheriffs, including the sheriffs of Cochise County and Pinal County. Their plan includes immediate deployment of 3,000 National Guard service members to the Arizona border with Mexico; the completion of 700 miles of fencing along the Arizona border with Mexico; full funding and implementation of Operation Streamline; the hiring and deployment of 3,000 Immigration and Customs Enforcement (ICE) agents by 2015, and millions of federal dollars to help local law enforcement deal with border crime.
While the bill that the senators introduced on May 6, itself, is not expected to move as a stand-alone measure. The two senators have signaled that they may use it as fodder for amendments to appropriations bills once those measures begin to move through the Senate.

Pro-Immigrant Community Growing Increasingly Angry Over Obama Administration's Posture on Comprehensive Immigration Reform

Anger toward President Obama and his Administration is growing in the pro-immigrant advocacy community as the President and senior officials continue what has become a familiar dance of showing a little leg on comprehensive immigration reform (CIR), and then quickly yanking it back.
Most recently, President Obama waxed eloquently on CIR during remarks that he made at a May 5 Cinco de Mayo celebration. However, once the dust had settled on the evening, advocates and the media who closely parsed his words and came to believe that the President had actually signaled more strongly than ever that he does not intend to pursue enactment of CIR legislation during the 111th Congress.
The belief that the White House has abandoned any hope that CIR legislation can be enacted into law during the 111th Congress was probably reinforced during the Thursday, May 5, 2010, White House Daily Briefing.
On Thursday, reporters parried with White House Press Secretary Robert Gibbs on immigration on four different occasions during the hour-long briefing. Each time, Gibbs minimized the likelihood that Congress would address CIR this year.

Arizona Governor Rejects Schumer Plea to Delay Implementation of Controversial Immigration Law

Senate Judiciary Subcommittee on Immigration, refugees, and Border Security Chairman Charles E. Schumer (D-NY) on Thursday wrote Arizona Governor Jan Brewer, asking that she delay implementation of SB 1070 for a year and work with him on enacting comprehensive immigration reform (CIR) legislation at the federal level. However, Governor Brewer rejected the Schumer proposal before the sun had set on it.
In his letter to the Arizona governor, Chairman Schumer wrote, "I cannot agree more that urgent federal action is necessary this year to address our broken immigration system." He continued, saying "I simply do not believe the remedy Arizona has enacted will succeed in resolving the problem it is designed to address. I oppose SB 1070, not only because it is wrong-hearted and is likely unconstitutional, but also because it will almost certainly fail to reduce illegal immigration into Arizona."
Chairman Schumer proposed an alternative approach to the governor, saying "there is work currently being done in the Senate to produce a bipartisan comprehensive immigration reform bill this year." The Chairman outlined the four pillars of his plan and criticized the McCain/Kyl 10-point border security plan as one that would not do as much as CIR to address the root causes of illegal immigration.
Chairman Schumer concluded his letter to Governor Brewer by asking that she "delay the enactment of SB 1070 for 1 year in order to permit Congress sufficient time to enact comprehensive immigration reform to address Arizona's security needs." He went on to write, "[t]his reform, however, cannot pass unless members from both sides of the aisle work together to reach a compromise. Consequently, I also ask that you publicly call on Senators mcCain and Kyl to immediately begin discussions with me to enact comprehensive immigration reform legislation before enactment of SB 1070 becomes necessary."

It is Appearing Increasingly Unlikely that the Senate Will Take Up DeMint Border Fencing Amendment to Financial Reform Bill

Senator Jim DeMint (R-SC) announced on Wednesday, May 5, that he plans to offer an amendment to pending financial regulatory reform legislation that would require the completion within a year of 700 miles of double-layered fencing along the United States border with Mexico. However, at the time of this writing, it is looking increasingly unlikely that the Senate will actually take up the DeMint fencing amendment to the financial regulatory reform measure.
The Senator filed the amendment to S. 3217, the "Restoring American Financial Stability Act of 2010", on Wednesday, May 5, and he could seek to offer it on the Senate floor at any time. Senator DeMint's amendment, Senate Amendment 3852, is one of more than one hundred that have been filed to the financial regulatory reform bill. Unlike most of the others, however, it is neither germane nor related to the subject matter of the underlying bill. As such, it is unclear whether the Senate will ever take it up. There will be no votes in the Senate on amendments to the financial regulatory reform bill on Friday, May 7, or Monday, May 10.
In announcing his plan to offer his fencing amendment, Senator DeMint said doing so would "follow through on the four-year-old promise made by Congress to secure the border under the Secure Fence Act of 2006." Senator DeMint quoted Department of Homeland Security (DHS) staff as saying that to date, only 34.3 miles of the mandated 700 miles of double layer fencing has been built. He says that 11.8 of that fencing has been built in California, 9.1 in Arizona, and 13.4 in Texas.
The South Carolina Senator offered a similar amendment last year in the Senate to H.R. 2892, the Department of Homeland Security Appropriations Act. The Senate approved the amendment at that time by a vote of 54-44, with 21 Democrats and 33 Republicans voting in favor of it. However, the DeMint amendment was one of several immigration and border enforcement amendments that were dropped from the Homeland Security Appropriations measure in conference.
“We’ve now had two administrations fail to keep their promise to the American people to secure our border and Americans are tired of excuses,” said Senator DeMint. “Americans have demanded a real fence to combat the very real problems of illegal immigration that have led to human trafficking, drug trafficking, kidnapping and violence on our border. Congress will never be able to achieve long-term reform to create a legal immigration system that works until we secure our borders.
“We’ve had rhetoric and promises for four years without results. It’s time we completed the fence and secured our borders to protect American citizens.”
If Senator DeMint’s amendment is signed into law, Secretary of Homeland Security Janet Napolitano would be required to submit a report to Congress within six months (or 180 days) after enactment of the law on the progress made and her plans for completing the fence within twelve months.

Lieberman Proposal to Strip Citizenship of Terror Suspects Fails to Gain Traction Among White House and Congressional Leadership

A proposal recently advanced by Senator Joe Lieberman (I-CT) to make it easier for the Federal government to strip the citizenship of suspected terrorists has gained little traction in the first hours since it was unveiled. Senator Lieberman, along with freshman Senator Scott Brown (R-MA) and Representative Jason Altmire (D-PA) announced their intention to introduce such a bill on Thursday, May 6.
In reaction to the proposal, White House Press Secretary Robert Gibbs said, “I have not heard anybody inside the administration that's been supportive of that idea,” Gibbs said. When pressed on the issue, Gibbs said he had “not heard large enumerations on why, except that I don't think anybody would find that to be such an effective way.”
Speaker of the House Nancy Pelosi and House Minority Leader John Boehner (R-OH) also expressed skepticism of the idea this week.
In her weekly press conference on Thursday. May 6, the Speaker said that while she appreciates “the spirit” of the proposal, she is concerned and that Congress should be very, very careful about such proposals. Minority Leader Boehner was less diplomatic in his criticisms, saying during his weekly press conference, “it would be pretty difficult, under the U.S. constitution” to strip someone of their citizenship." He added, "If they’re a U.S. citizen, until they’re convicted of some crime, I don’t know how you would attempt to take their citizenship away.”
In explaining the rationale of his bill, Senator Lieberman said, "our enemies today are stateless actors who don’t wear uniforms." He went on to say, "it has become a strategy of al-Qaeda and other Islamist terrorist groups over the past couple of years to recruit U.S. citizens who can train overseas and then use their American passports to re-enter the U.S. for the purposes of planning and carrying out attacks against us."
Under current law, the citizenship of American citizens can be legally taken away from any adult who, among other actions, obtains naturalization in a foreign state, makes a formal declaration of allegiance to a foreign state, serves in the armed forces of a foreign state if engaged in hostilities against the United States, makes a formal renunciation of nationality before a diplomatic or consular officer of the US in a foreign state, or commits any act of treason.

Obama Breaks No New Ground As He Blasts Arizona Law and Talks of "Begin[ning]" Work on Comprehensive Immigration Reform

President Barack Obama addressed both comprehensive immigration reform and the controversial new Arizona immigration enforcement law in on Wednesday, May 5, during a Cinco de Mayo event at the White House. While the President was adamant in his expression of opposition to the Arizona law and firm in his support for comprehensive immigration reform, his remarks broke no new ground and offered no new timeline on either issue. Indeed, the President repeated a line that he had earlier used to little notice, saying that we should "begin" to work on comprehensive immigration reform this year, signalling that he may well be in no hurry to move legislation before the end of the 111th Congress.
In remarks on May 5, 2010, at a Cinco de Mayo reception in the Rose Garden, the President said of the Arizona law, "we have to close the door on this kind of misconceived action by meeting our obligations here in Washington." The President also said, "We can't start singling out people because of who they look like or how they talk or how they dress... we can't turn law-abiding American citizens or law abiding immigrants into subjects of suspicion and abuse."
The President conceded in his remarks that the United States immigration system is broken and that Americans have a right tobe frustrated. However, he said that "the answer isn't to undermine fundamental principles that define us as a nation."
With regard to comprehensive immigration reform legislation, the President said, "I want to say it again, just in case anybody is confused. The way to fix our broken immigration system is through common-sense, comprehensive immigration reform. That means responsibility from government to secure our borders, something we have done and will continue to do. It means responsibility from businesses that break the law by undermining American workers and exploiting undocumented workers -— they’ve got to be held accountable. It means responsibility from people who are living here illegally. They’ve got to admit that they broke the law, and pay taxes, and pay a penalty, and learn English, and get right before the law -- and then get in line and earn their citizenship.
"Comprehensive reform —- that’s how we’re going to solve this problem. And I know there’s been some commentary over the last week since I talked about this difficult issue: Well, is this politically smart to do? Can you get Republican votes? Look, of course, it’s going to be tough. That’s the truth. Anybody who tells you it’s going to be easy or I can wave a magic wand and make it happen hasn’t been paying attention how this town works.
"We need bipartisan support. But it can be done. And it needs to be done. So I was pleased to see a strong proposal for comprehensive reform presented in the Senate last week —- and I was pleased that it was based on a bipartisan framework. I want to begin work this year, and I want Democrats and Republicans to work with me -- because we’ve got to stay true to who we are, a nation of laws and a nation of immigrants."

Immigration Issue Raised Against Carly Fiorina and Meg Whitman in their Races to Win the GOP Nomination for Senate and Governor

California Assemblyman Chuck DeVore (R-Orange County) has raised immigration as an issue in his campaign for the Republican nomination to take on Senator Barbara Boxer (D-CA). In the commercial, above and to the left, the Assemblyman links his principal GOP opponent, former Hewlett Packard CEO Carly Fiorina, to Senator John McCain (R-AZ), criticizes her for opposing the Arizona immigration enforcement bill, and accuses her of flip-flopping on the immigration issue.
In the meantime, immigration and the Arizona immigration enforcement law also has become an issue in the California's governor's race. California State Insurance Commissioner Steve Poizner has put together an ad that uses footage from a recent GOP debate to attack his principal opponent, former eBay CEO Meg Whitman, for her opposition to the Arizona law.

A Light Week On Tap for Immigration and Refugee Legislation After Several Tumultuous Weeks of Jockeying and Positioning

As the week of May 3, 2010, begins, just one hearing, no markups, and no floor activity on immigration- or refugee-related legislation were scheduled for this week.
This week's relatively light immigration legislative schedule comes after one of the most tumultuous periods for immigration legislation in recent memory.
As last week began, Senator Lindsey Graham (R-SC) walked away from a comprehensive immigration reform (CIR) bill that he had been drafting along with Senate Judiciary Subcommittee on Immigration, Refugees, and Border Security Chairman Charles Schumer (D-NY). That move prompted Democrats to decide to go-it-alone to draft their own CIR plan.
Throughout last week, Senate Majority Leader Harry Reid (D-NV) made a number of conflicting statements about when the Senate might take up a CIR bill. President Obama, too, made conflicting remarks thoughout the week about the prospects of taking up CIR legislation before the end of the 111th Congress.
At week's end, Senate Democrats had released a 26 page-long framework for comprehensive immigration reform, however the Senate Democratic Leadership has not indicated whether or when that measure will be translated into legislative language or taken up on the Senate floor.

Even in the face of an unusually busy newsday, immigration was again one of the focal points zeroed-in-on during the public affairs programs on Sunday, May 2, 2010.
Much like last week, the discussions this weekend on immigraton focused on two matters: the new immigration enforcement law in Arizona and the push for comprehensive immigration reform.
The following presents video of some of the comments and discussion about immigration on this past weekend's public affairs programs:

Among the guests appearing on the May 2, 2010, edition of ABC's "This Week" were Secretary of Homeland Security Janet Napolitano and Secretary of Interior Ken Salazar, both of whom addressed immigration during their interview segment. Appearing on the program during the roundtable segment were Reverand Al Sharpton, Bill Maher, Matthew Dowd, Katrina vanden Heuvel, and George F. Will. CNN also interviewed former Florida Speaker of the House Marco Rubio (R-FL), a Cuban-American who is a candidate for the U.S. Senate seat being vacated by retiring Senator George Lemieux (R-FL), and Florida Governor Charlie Crist (I-FL), also a candidate for that seat. Rubio, who is favored by the "Tea Party" movement, has been an opponent of comprehensive immigration reform legislation. However, he has come out in recent days against the Arizona immigration enforcement law.
