House Judiciary Committee Approves Bill to Eliminate the
Diversity Visa Lottery Program

The House Committee on the Judiciary has approved a bill that would eliminate the Diversity Visa Lottery program.  Committee action occurred on Friday, July 15, 2011, in connection with H.R. 704, the "SAFE for America Act", legislation introduced by Representative Bob Goodlatte (R-VA).  The Committee approved the measure by a vote of [17-14] after taking up [five] amendments that were offered to it, rejecting all five of them.  

As approved by the House Committee on the Judiciary, H.R. 704 would eliminate the Diversity Visa program and its 55,000 visas, effective October 1, 2011.  The bill would not reallocate the lost visas to either the family sponsored or employment sponsored immigration systems.


Opposition in Committee
Opposition to H.R. 704 in the House Judiciary Committee centered around several themes.  First, Democratic opponents of the bill argued that while the Diversity program has experienced high levels of attempted fraud in the application process, those problems were correctable, that the Diversity Visa program provides great benefits to the United States by promoting diversity in our immigration system, and that the program should be reformed rather than elimninated.  Second, opponents of the bill argued that supporters of the bill simply oppose legal immigration.  If that is not so, they contended, the bill would have reallocated the eliminated visas to either the family-sponsored or employment-sponsored immigration preference systems.  And third, opponents of the bill argued that the bill's supporters were opposed to diversity in the immigration system.

Representative Goodlatte and House Judiciary Committee Chairman Lamar Smith (R-TX) defended the bill, saying that the Diversity Visa program is rife with fraud, has resulted in a number of criminals and terrorists entering the United States, and that that the country (and the country's immigration system) is already diverse and does not need a diversity visa program.


Amendments Agreed To
The Committee did not agree to any amendments during its markup of H.R. 704.


Amendments Rejected
Five amendments that the Committee took up were not agreed to, either because they were ruled out of order, withdrawn, or rejected outright.

The following summarizes those amendments:
  • Jackson-Lee Recommendations to Eliminate Fraud in the Diversity Visa Program Amendment.  Representative Shelia Jackson Lee (D-TX), offered an amendment that would have stricken the provisions in the bill eliminating the Diversity Visa program and replaced them with a requirement that the Department of Homeland Security, in consultation with the Department of State, submit a plan to the House and Senate Judiciary Committees on how to eliminate fraud in the Diversity program.
The Committee rejected the Jackson Lee Sense of Congress Amendment by a vote of [insert vote].

  • Lofgren "Family Diversity" Visa Program Amendment.  House Judiciary Subcommittee on Immigration Policy and Enforcement Ranking Minority Member Zoe Lofgren (D-CA) offered an amendment that would have eliminated the Diversity Visa program and replaced it with a "Family Diversity" program.  Under the Lofgren "Family Diversity" program, 55,000 visas would have been available to any person qualifying for visas under the existing family-sponsored preference system.  However, those visas would have been distributed based on the same formula that exists in the current Diversity Visa program.  Applicants for the "Family Diversity" program would have undergone the same process for admission as that which exists in the current family-sponsored immigration preference system.
The Committee rejected to the Lofgren "Family Diversity" Visa Amendment by a vote of [insert vote].

  • Lofgren Reallocation of Visas to Family and Employment Preference Systems Amendment.  House Judiciary Subcommittee on Immigration Policy and Enforcement Ranking Minority Member Zoe Lofgren (D-CA) offered an amendment that would have reallocated the 55,000 Diversity Visas that the bill would eliminate so that half of them would be reallocated to the family-sponsored preference system and half would be reallocated to the employment-sponsored preference system.

  • Lofgren Reallocation of Visas to Family Preference Backlog Amendment.  House Judiciary Subcommittee on Immigration Policy and Enforcement Ranking Minority Member Zoe Lofgren (D-CA) offered an amendment that would have reallocated the 55,000 Diversity Visas that the bill would eliminate so that they would be used to reduce backlogs in the family-sponsored immigration preference system.  The amendment would have delegated to the Secretary of State how the backlog reduction visas would be allocated within the four family preference categories.
The Committee rejected to the Lofgren Reallocation of Visas to Family Preference Backlog Amendment by a vote of [insert vote].

  • Lofgren Reallocation of Visas to Family and Employment Preference Backlog Amendment.  House Judiciary Subcommittee on Immigration Policy and Enforcement Ranking Minority Member Zoe Lofgren (D-CA) offered an amendment that would have reallocated the 55,000 Diversity Visas that the bill would eliminate so that they would be used to reduce backlogs in the family-sponsored and employment-sponsored immigration preference systems, with half of the reallocated visas going to the employment-sponsored system and half going to the family-sponsored system.  The amendment would have delegated to the Secretary of State how the backlog reduction visas would be allocated within the preference categories.

Next Steps
Now that the House Committee on the Judiciary has approved H.R. 704, the next step in the legislative process is for the Committee to prepare a formal written report on the measure and then to formally report the bill to the full House of Representatives.  Following that, the House could take up the measure at any time. 



 



 






 

House Convenes First Session of the 112th Congress

The U.S. House of Representatives has convened the first session of the 112th Congress.  It did so today at 12:00 Noon EST. 

Republicans have a 242-193 majority in the House.

Much of Congress’ work this week and over the next several weeks will concentrate on the ceremonial and organizational aspects of convening a new Congress.  However, its work will not be limited to organizational matters during the early weeks of its existence; President Obama will make his State of the Union Address within the next few weeks, he will submit his fiscal year 2012 budget to Congress during the second week of February, and the 112th Congress will have to complete consideration of the fiscal year 2011 appropriations bills before March 4.

Immigration is an Unlikely Topic of Discussion on the Coming Weekend's Sunday Public Affairs Programs

Taxes, spending, the START Treaty, and Don't Ask; Don't Tell dominate the media's attention as the 111th ongress prepares to enter what is almost certainly its last two weeks of session.  Given that, despite the fact that the DREAM Act is poised on the precipice of either enactment or defeat, little talk about immigration is likely to occur on the coming weekend's Sunday public affairs programs
.

The programs that are most likely to feature immigration discussions are CNN's "State of the Union", which features Senator Richard Lugar (R-IN); FOX's "FOX NEWS Sunday", which has former House Speaker Newt Gingrich (R-GA) as one of its guests; NBC's "Meet the Press", which will interview Senate Minority Leader Mitch McConnell (R-KY); and CBS's "Face the Nation" program, which features Assistant Senate Majority Leader Dick Durbin (D-IL), author of the DREAM Act, and Senate Minority Whip Jon Kyl (R-AZ).


The following is a guide to what can be expected on the coming weekend's programs:
  • ABC - This Week.  Among the guests appearing on the December 12, 2010, edition of  ABC's "This Week" program will be Secretary of the Treasury Timothy Geithner; the Prime Minister of the Palestinian Authority, Salam Fayyad; and Israeli Opposition Leader and former Foreign Minister, Tzipi Livni.

The programs that are most likely to feature immigration discussions are CNN's "State of the Union", which features Senator Richard Lugar (R-IN); FOX's "FOX NEWS Sunday", which has former House Speaker Newt Gingrich (R-GA) as one of its guests; NBC's "Meet the Press", which will interview Senate Minority Leader Mitch McConnell (R-KY); and CBS's "Face the Nation" program, which features Assistant Senate Majority Leader Dick Durbin (D-IL), author of the DREAM Act, and Senate Minority Whip Jon Kyl (R-AZ).

    FOX - FOX News Sunday.  Among the guests appearing on the December 5, 2010, edition of FOX's "FOX News Sunday" will be former Speaker of the House Newt Gingrich (R-GA), who recently unveiled his own immigration strategy.  Also appearing on the program will be Senate Budget Committee Chairman Kent Conrad (D-ND) and Representative Jeb Hensarling (R-TX).  Appearing this week during the roundtable segment of the program will be Dana Perino, former White House Press Secretary under President George W. Bush and current FOX News Contributor; Nina Easton of Fortune Magazine and FOX News; Juan Williams of FOX News; and Liz Cheney, Former State Department Official and daughter of former Vice President Dick CheneyGiven the lineup of guests, it is likely that the subject of immigration will come up during the program, particulaly in the segment with former House Speaker Newt Gingrich

This week's Sunday Public Affairs Programs are unlikely to contain any significant discussions on immigration.  The programs that are most likely to feature immigration discussions are CBS News' "Face the Nation" program, which features outgoing House Majority Leader Steny Hoyer (D-MD), and NBC News' "Meet the Press" program, which features Tea Party-backed Representative-Elect Allen West (R-FL).


The following is a guide to what can be expected on this weekend's Sunday's programs:
  • ABC - This Week.  Among the guests appearing on the November 21, 2010, edition of  ABC's "This Week" will be Admiral Mike Mullin, Chairman of the Joint Chiefs of Staff.  The subject of immigration is unlikely to come up during his segment of the show.  Participating in the roundtable discussion segment of the program will be ABC News' George F. Will; Democratic strategist Donna Brazile; Ed Luce of the Financial Times; and former Labor Secretary Robert Reich.  It is unlikely, as well, that the subject of immigration will be discussed in the roundtable discussion segment of the program.
  • CBS - Face the Nation.  Among the guests appearing on the November 21, 2010, edition of CBS's "Face the Nation" will be the Representative Steny Hoyer (D-MD), the outgoing House Majority Leader and incoming House Democratic Whip.  Also appearing on the program will be Secretary of State Hillary Rodham Clinton.  The subject of immigration is unlikely to come up during the segment of the program featuring Secretary Clinton.  However, it is possible that the subject could be discussed during the segment with Representative Hoye.

  • CNN - State of the Union.  The guest list for the November 21, 2010, edition of CNN's "State of the Union" program includes Admiral Mike Mullin, Chairman of the Joint Chiefs of Staff.  Also appearing on the program will be John Postole, the administrator of the Transportation Security Administration, and Representative John Mica (R-FL), the Ranking Republican (and likely incoming Chairman) of the House Committee on Transportation and Infrastructure.  Given the lineup of guests, it is likely that the subject of immigration will come up during the program.

    FOX - FOX News Sunday.  Among the guests appearing on the November 21, 2010, edition of FOX's "FOX News Sunday" will be Secretary of State Hillary Rodham Clinton and Governor Rick Perry, the new Chairman of the National Governors Association.   It is possible that the subject of immigration will be broached during the segment of the program featuring Governor Perry.  Appearing this week during the roundtable segment will be Bill Kristol of the Weekly Standard and FOX News; Juan Williams of FOX News; A.B. Stoddard of The Hill; and Kevin Madden, Former press secretary to Governor Mitt Romney (R-MI).
  • NBC - Meet the Press.  Appearing on the November 21, 2010, edition of NBC's "Meet the Press" will be Secretary of State Hillary Rodham Clinton and Governor Bobby Jindal (R-LA). Appearing on the progran during the roundtable segment will be opinion journalist Robert Draper; The Wall Street Journal's Paul Gigot; Tea Party-backed Representative-Elect Allen West (R-FL); and Richard Wolffe, author of the new book "Revival: The Struggle for Survival Inside the Obama White House."  The subject of immigration is unilkely to come up during the interview portion of the program.  However, it could come up during the roundtable discussion.

Sunday public affairs programs, the subject of immigration was lightly touched upon last week with the appearance by former Secretary of State Colin Powell on NBC's "Meet the Press" program.  This week is likely to be different, given the appearances by Assistant Senate Majority Leader Richard Durbin (D-IL), Senate Minority Leader Mitch McConnell (R-KY), House Minority Leader John Boehner (R-OH), and U.S. Senate GOP candidates Marco Rubio and Ken Buck. 

The following is a guide to what can be expected on this weekend's Sunday's programs:
  • ABC - This Week.  Among the guests appearing on the September 26, 2010, edition of  ABC's "This Week" will be Senate Minority Leader Mitch McConnell (R-KY); Senior White House Advisor David Axelrod; and Queen Raina of Jordan.  The subject of immigration could come up during the segments with Senator McConnell and David Exelrod.  Participating in the roundtable discussion segment of the program will be ABC News' George F. Will; Democratic strategist Donna Brazile; Matthew Dowd, political strategist for former President George W. Bush; and Ron Brownstein of the National Journal.

    FOX - FOX News Sunday.  Among the guests appearing on the September 26, 2010, edition of FOX's "FOX News Sunday" will be House Majority Leader Steny Hoyer (D-MD), House Minority Leader John Boehner (R-OH), and Chief Deputy House Minority Whip Kevin McCarthy (R-CA).  It is quite possible that the subject of immigration will be broached during their segments of the program.  Appearing this week during the roundtable segment will be FOX News Senior Political Analyst Brit Hume; Mara Liasson of National Public Radio and a FOX News contributor; Bill Kristol of the Weekly Standard and FOX News; and Juan Williams of National Public Radio and FOX News.

Now that Congress is deep into its August recess and the varous lawsuits and the preliminary rulings on the lawsuits challenging the recently enacted immigration enforcement laws in Arizona and Fremont, Kansas are being studied and appealed, immigration is unlikely to be  featured at all on most of the August 22, 2010, Sunday public affairs programs.  Indeed, to the extendt that the subject is likely to come up on Sunday the 22nd, it is only likely to do so on NBC's "Meet the Press" in the context of the 2010 mid-term congressional elections.

The following is a guide to what can be expected on immigration on Sunday's programs:
  • ABC - This Week.  Among the guests appearing on the August 22, 2010, edition of  ABC's "This Week" will be Hamid Karzai, President of Afghanistan.  Also appearing on the program will be Daisy Khan, wife of Imam Feisal Abdul-Rauf, the organizaer of the controversial Islamic Center that is being planned two blocks from Ground Zero in New York City, and Rabbi Joy Levitt, head of the Jewish Community Center in Manhattan that is considered a model for the Islamic center. Participating in the roundtable discussion segment of the program will be ABC News's George F. Will, former Clinton Labor Secretary Robert Reich, Judy Woodruff of the PBS News Hour and Bloomberg's Al Hunt.  Given the lineup of guests, the subject of immigration is not likely to come up during the program.
  • CBS - Face the Nation.  Among the guests appearing on the August 22, 2010, edition of CBS's "Face the Nation" will be General Ray Odierno, Commander of U.S. Forces in Iraq, Senator Lindsey Graham (R-SC), author Greg Mortenson, and General David Petraeus, Commander of U.S. Forces in Afghanistan.  The subject matter for the program will be the wars in Iraq and Afghanistan.  However, given the appearance by Senator Lindsey Graham on the program, there is a remote (but only remote) possibility that the subject of immigration will come up.

  • CNN - State of the Union.  The guest list for the August 22, 2010, edition of CNN's "State of the Union" program includes General Ray Odierno, U.S. Commander in Iraq; Zalmay Khalilzad, former U.S. Ambassador to Iraq and Afghanistan; Admiral William Fallon (Retired), former Commander, U.S. Central Command; Gen. Richard Myers (Retired), former Chairman of the Joint Chiefs of Staff; and Howard Dean, former Democratic National Committee (DNC) Chairman and former Governor of Vermont.  Given the lineup of guests, it is unlikely that the subject of immigration will come up during this week's program.

    FOX - FOX News Sunday.  Among the guests appearing on the August 22, 2010, edition of FOX's "FOX News Sunday" will be former Illinois Governor Rod Blagojevich (D-IL).  Appearing this week during the roundtable segment will be Stephen Hayes of the Weekly Standard and FOX News; Nina Easton of Fortune Magazine and FOX News; Kevin Madden, former National Press Secretary to Mitt Romney's Presidential Campaign; and Juan Williams of National Public Radio and FOX News.  Given the lineup of guests, it is unlikely that the subject of immigration will come up during this week's program.
  • NBC - Meet the Press.  Appearing on the August 22, 2010, edition of NBC's "Meet the Press" will be Senate Minority Leader Mitch McConnell (R-KY), former House Majority Leader Dick Armey (R-TX), and Governor Jennifer Granholm (D-MI).  Appearing on the program during its roundtable segment will be former Representative Rick Lazio, who is the leading Republican candidate for Governor of New York; the Atlantic's Jeffrey Goldberg; The Wall Street Journal's Paul Gigot, and BBC World News America's Katty Kay.  While not a certainty, it is possible that the subject of immigration will come up during all three segments of the program.

Just when it was believed that immigration would recede as a hot topic on the Sunday public affairs programs, the issue proved its resiliancy on Sunday, August 15, coming up on three of the week's five Sunday programs, including on CBS's "Face the Nation" and FOX's FOX's "FOX News Sunday" programs.

The following summarizes the immigration discussions during the programs:
  • ABC - This Week.  Among the guests appearing on the August 15, 2010, edition of  ABC's "This Week" will be University of California at Berkeley Professor Laura D'Andrea Tyson; Senator Bob Corker (R-TN); and former Senator and former Governor Jon Corzine (D-NJ).  Given the lineup of guets, it is unlikely that the subject of immigration will come up during the interview portion of the program.  Participating in the roundtable discussion segment of the program will be Republican strategist Matthew Dowd and Cokie Roberts of National Public Radio and ABC News.
  • CBS - Face the Nation.  Among the guests appearing on the August 15, 2010, edition of CBS's "Face the Nation" were former Governor Tim Kaine (D-VA), Chairman of the Democratic National Committee; (DNC) Governor Ed Rendell (D-PA) a former Chariman of the DNC; Ed Gillespie, former Chairman of the Repubilcan National Committee (RNC); and Republican strategist Ed Rollins.  The discussion between the four former party officials included an extensive discussion on the subject of birthright citizenship and the 14th Amendment to the U.S. Constitution, as well as on comprehensive immigration reform.

  • CNN - State of the Union.  The guest list for the August 15, 2010, edition of CNN's "State of the Union" program includes Reprseenative Chris Van Hollen (D-MD), Chairman of the Democratic Congressional Campaign Committe (DCCC), and Representative Kevin McCarthy (R-CA).  The discussion during that segment of the program will likely concentrate on prospects for the upcoming mid-term congressional elections.  Appearing on the August 15 program during it's political roundtable segment will be Steven Pearlstein of The Washington Post and Jeanne Cummings of Politico.  Finally, the August 15 edition of the program will feature a discussion with climatologists Thomas P. Wagner of the National Aeronomics and Space Administration (NASA) and Heidi Cullen of the Climate Central, who will discuss climate change.  The subject of immigration is not expected to come up during their segment of the program.

Just when it appeared that the subject of immigration would recede into the background on the Sunday public affairs programs, it reemerged on Sunday, August 8, with discussions on the hot-bed issue of birthright citizenship for the children of undocumented aliens occuring on four of the five major programs, including on
ABC's "This Week," CBS's "Face the Nation," CNN's "State of the Union," and NBC's "Meet the Press" programs.

The following summarizes the immigration discussions during the programs:
  • ABC - This Week.  Among the guests appearing on the August 8 edition of  ABC's "This Week" program were George Packer of the New Yorker; Gillian Tett of the Financial Times; Politico's John Harris; and The Washington Post columnist and former Bush speechwriter Michael Gerson.  The panel explored the issue of birthright citizenship, which a number of Republicans have suggested be barred by amending the Fourteenth Amendment to the U.S. Constitution.
  • CBS - Face the Nation.  Among the guests appearing on the August 8 edition of CBS's "Face the Nation" were Dan Balz of The Washington Post and CBS’ Jan Crawford, who discussed Republican suggestions that the Fourteenth Amendent to the U.S. Constitution be amended to bar birthright citizenship for children of illegal immigrants who are born in the United States. 
  • CNN - State of the Union.  The guest list for the August 8 edition of CNN's "State of the Union" program included Governors Jennifer Granholm (D-MI) and Bob McDonnell (R-VA),  who briefly discussed immigration policy. 
  • NBC - Meet the Press.  Appearing on the August 8 edition of NBC's "Meet the Press" was House Minority Leader John Boehner (R-OH), who indicated support for considering amending the Fourteenth Amendment to the U.S. Constitution to bar birthright citizenship for the children of undcocumented aliens who are born in the United States.

Furor Grows in Utah Over "The List"

Furor is growing in Utah over "The List." 

On Friday, July 16, 2010, authorities in Utah determined that at least two state employees are responsible for illegally culling information from state social services databases to compile and then distribute a list of persons who they alledge are illegal immigrants.  The story broke at a time when Utah was in the midst of deciding whether it will enact an Arizona-style immigration enforcement law and just before the Governor was scheduled to host a roundtable discussion on immigration.

On Friday, Governor Gary R. Herbert (R-UT) and Kristen Cox, head of the Utah Department of Workforce Services, held a press conference to discuss the situation.
